Fostul decan al Facultăţii de Teologie din cadrul Universităţii ”Ovidius” din Constanţa, Bogdan Moise, a fost achitat, marţi, de Tribunalul Constanţa, pentru fals intelectual, decizia instanţei nefiind definitivă şi putând fi atacată la Curtea de Apel Constanţa.
Tribunalul Constanţa a hotărât, marţi, să schimbe încadrarea juridică pentru Bogdan Moise, fostul decan al Facultăţii de Teologie, din infracţiunile reţinute prin rechizitoriu, fals intelectual şi complicitate la instigare la abuz în serviciu, într-o singură infracţiune, cea de fals intelectual. Apoi, instanţa a decis achitarea acestuia “întrucât fapta nu a fost comisă cu forma de vinovăţie cerută de lege”.
Decizia Tribunalului nu este definitivă şi poate fi atacată cu apel în termen de 10 zile de la comunicare, la Curtea de Apel Constanţa.
În toamna anului trecut, procurorii DNA Constanţa au dispus trimiterea în judecată, în stare de libertate, a lui Bogdan Moise, decan al Facultăţii de Teologie din Constanţa, pentru săvârşirea infracţiunilor de complicitate la instigare la abuz în serviciu şi fals intelectual.
Totodată, procurorii anunţau că au transmis instanţei acordul de recunoaştere a vinovăţiei semnat de Bogdan-Florin Chiriluţă, cercetat sub control judiciar pentru fals în declaraţii în formă continuată, uz de fals şi instigare la abuz în serviciu.
Potrivit DNA, în perioada 2013 – 2015, Bogdan-Florin Chiriluţă, în calitate de candidat la posturile didactice scoase la concurs de Facultatea de Teologie, a întocmit în fals un număr de şase declaraţii pe propria răspundere pe care le-a depus la dosarul personal.
Ulterior, conducerea Universităţii ”Ovidius” Constanţa, i-a acordat titlurile de lector, respectiv conferenţiar universitar şi l-a numit pe aceste posturi, concomitent cu efectuarea, în perioada februarie 2014 – iunie 2017, a unor plăţi ilegale (salarii brute) în sumă totală de aproximativ 118.570 lei.
În acelaşi context, în cursul lunii aprilie 2017, Bogdan-Florin Chiriluţă a prezentat Comisiei de verificare a activităţii ştiinţifice şi de cercetare a candidaţilor înscrişi la concursul pentru ocuparea posturilor didactice de conferenţiar şi profesor în cadrul Universităţii ”Ovidius” din Constanţa, în fotocopie, o revistă, susţinând că în cuprinsul ei ar fi publicat un articol de specialitate.
